1. Acceptance of Terms

By accessing or using PBookShare, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Service Description

PBookShare is a free platform that enables users to list books they own and connect with nearby readers for borrowing and sharing. We facilitate connections but are not a party to any book-lending arrangement between users.

3. User Accounts

You must provide a valid email address to register. You are responsible for maintaining the security of your account credentials. Each person may only maintain one account.

4. Acceptable Use

You agree to:

• List only books you actually own or have permission to share
• Provide accurate location information (city-level)
• Return borrowed books within the agreed timeframe
• Treat other users with respect and courtesy
• Not use the platform for commercial purposes

5. Platform Limitation, Disclaimer of Liability & Lost/Damaged Books

PBookShare is a discovery platform only. We connect lenders and borrowers, but we are not responsible for: arranging or confirming the physical exchange; the lender's or borrower's availability or responsiveness; the condition of books exchanged; failure of users to return borrowed books; any disputes, losses, damage, or theft of books.

Once a borrow request is approved, it is the responsibility of both parties to contact each other directly to arrange pickup or return. PBookShare does not facilitate, monitor, or guarantee that any exchange will take place.

PBookShare is provided "as is" without warranties of any kind. We are not responsible for: the condition of books exchanged between users; failure of users to return borrowed books; any disputes between users; loss, damage, or theft of books.

5a. Fraudulent or Misrepresented Listings

Lenders must accurately represent the condition, title, and availability of books they list. Material misrepresentation (for example, listing a book as 'like-new' when it is in 'poor' condition, or listing a book you do not own) may result in immediate account suspension or termination. Borrowers who receive a book materially different from its listing may report the lender via our support page. PBookShare does not guarantee any listing's accuracy and is not liable for losses arising from inaccurate descriptions.

5b. Personal Safety

PBookShare does not arrange, supervise, or participate in any in-person meeting between users. You are solely responsible for your personal safety when meeting another user to exchange a book. We strongly recommend:

• Meeting in well-lit, public locations (a coffee shop, library, or busy street)
• Bringing a friend or letting someone know where you are going
• Trusting your instincts — if something feels wrong, cancel the exchange

PBookShare is not liable for any personal injury, theft, assault, harassment, or other harm that occurs during or as a result of a user-arranged meetup facilitated through this platform.

6. Indemnification

You agree to indemnify, defend, and hold harmless PBookShare, its owner, and any affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your interaction with any other user; or (d) any book exchange you participate in, including but not limited to lost, stolen, damaged, or unreturned books; (e) any content or photos you upload; or (f) any claim that your content infringes the rights of any third party.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBOOKSHARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. PBOOKSHARE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ZERO DOLLARS (/bin/zsh.00), AS PBOOKSHARE IS PROVIDED FREE OF CHARGE.

PBOOKSHARE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Age Restrictions

PBookShare is intended for users aged 13 and older. Users under the age of 18 must have parental or guardian consent to use this platform. By registering, you confirm that you are at least 13 years old. We reserve the right to terminate accounts of users who do not meet this age requirement.

9. Force Majeure

PBookShare shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet outages, or third-party service failures.

10. Dispute Resolution

Any disputes between users (for example, regarding unreturned books or misrepresented listings) must be resolved directly between those users. PBookShare does not mediate user disputes and provides no dispute resolution service.

Any legal dispute between a user and PBookShare shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), governed by the laws of the State of Delaware, United States. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. User Content

You retain ownership of content you submit (book listings, descriptions, profile information). By posting content, you grant PBookShare a non-exclusive license to display this content to other users of the platform for the purpose of operating the service.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, post inappropriate content, or abuse other users. You may delete your account at any time from your profile settings.

13. Intellectual Property

The PBookShare name, logo, and platform design are the property of PBookShare. Book cover images and metadata are used for identification purposes under fair use.

14. Changes to Terms

We may update these terms periodically. Continued use of the service after changes constitutes acceptance of the revised terms. Material changes will be communicated via email.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in courts located in Delaware. By using PBookShare, you consent to the personal jurisdiction of those courts.

• Your phone number may be shared with an approved borrower for the sole purpose of arranging the book exchange.
• Approved borrowers may contact you via phone call or text/SMS to coordinate pickup or return of the book.
• You may receive such contact only from users whose borrow request you have explicitly approved.

Restrictions on borrowers: If you receive a lender's phone number after your request is approved, you may only use it to arrange the book exchange. Unsolicited calls, texts, marketing, or harassment using contact details obtained through PBookShare is a violation of these Terms and may result in immediate account termination.

By providing your phone number on this platform, you confirm you have read this consent and agree to these terms. You can withdraw consent at any time by removing your phone number from your profile.

16. Photo & Content Ownership (User-Generated Content)

By uploading photos or content to PBookShare, you confirm that: (a) you own the content or have explicit permission to use it; (b) it does not infringe any copyright, trademark, or privacy rights; (c) it is not unlawful or objectionable. You grant PBookShare a non-exclusive, royalty-free licence to display your content solely to operate the platform. You retain ownership. If you believe your IP has been infringed, contact support@pbookshare.com and we will investigate promptly.

17. Platform Availability & Service Changes

PBookShare is provided on an "as is, as available" basis with no uptime guarantee. We may modify, suspend, or discontinue the platform or any feature at any time without notice or liability to you.

18. Impersonation & Fake Profiles

You may not impersonate any person, business, or entity, use another's photo or likeness without consent, create multiple accounts to circumvent a ban, or use misleading display names. Impersonation may constitute fraud and will result in immediate account termination. Where appropriate, PBookShare may report such conduct to law enforcement.

19. Phone Number & Contact Consent

When you list a book and provide a phone number, you explicitly consent to: (a) your phone number being shared with an approved borrower solely to arrange the book exchange; (b) receiving calls or texts from that borrower to coordinate pickup or return. Borrowers may only use a lender's phone number for arranging the exchange — unsolicited contact, marketing, or harassment is a violation of these Terms and may result in immediate account termination. You may withdraw consent at any time by removing your phone number from your profile.
